The limited company was set up for the maintenance and upkeep of communal gates situated at the entrance of a close of 5 houses and general mainentance of communal areas including a large grassed area situated within the confines of the gated area.
The grassed area was purchased by the occupants of 1, 2, 3, 4 and 6 Bayeux in December 2021 from Wimpey Homes. The land has no commercial value to the residents. It has covenants preventing development, the erection of a house or similar structure and has several trees on which there are TPO's (tree preservation orders). However, the residents wanted to preserve the area that they had been maintaining at their own cost for a number of years.
The transaction was put through Bayeux Residents Limited (as opposed to each of the residents) to keep everything simple from a land registry perspective, particularly in the event of the sale of any of the properties. The land is not included as an asset of the limited company as it has no commercial value.
Each shareholder owns an equal share of the land that is transferable in the event of the sale of any of the properties to a new owner.
