Basis of preparing the financial statements |
In the opinion of the directors, the provisions of Section 42 of the Landlord & Tenant Act 1987 do not apply to the company and therefore: |
No statutory trust has been imposed on service charges rendered by the company; |
The financial statements do not include any adjustments that would arise as a consequence of the existence of such a trust. |
Turnover |
Maintenance contributions are agreed with the members annually and any surpluses or deficits arising during the year are taken into account when setting the following years budgets. |
Surplus charges are not returned in the form of dividends, since to do so would represent a distribution on which income tax would be due (and may not be reclaimable by individual members). Instead, the funds are retained by the company to expend in future periods. |
Excess maintenance contributions arising as a consequence of changes in the annual charges, are credited to income as donations, with the agreement of the member concerned. Otherwise, they are carried forward as a liability of the company. |
Taxation |
The company does not undertake any form of economic or investment activities which should be brought within the scope of corporation tax. |

4. | FIXED ASSETS |
Freehold land of approximately 2.5 acres adjacent to Fan Court was purchased in July 1988 for £33,000. |
The directors acknowledge their responsibilities for: |
(a) | ensuring that the company keeps accounting records which comply with Sections 386 and 387 of the Companies Act 2006 and |
(b) | preparing financial statements which give a true and fair view of the state of affairs of the company as at the end of each financial year and of its profit or loss for each financial year in accordance with the requirements of Sections 394 and 395 and which otherwise comply with the requirements of the Companies Act 2006 relating to financial statements, so far as applicable to the company. |
