The company holds a freehold property on behalf of its leaseholders under an implied trust arrangement. The company does not have beneficial ownership of the property.
The company receives variable service charge contributions from the leaseholders flats within 127 Drakefield Road pursuant to the service charge provisions in each leaseholder's 999-year lease. These contributions are calculated as a fair and reasonable proportion of actual costs incurred in maintaining and insuring the building and setting aside reserves for future repairs.
Under section 42 of the Landlord and Tenant Act 1987, all service charge contributions and the accumulated sinking fund are held by the company on statutory trust for the contributing leaseholders. The trust fund balance, held in a bank account in the company's name, is not beneficially owned by the company and is therefore not recognised in these financial statements. A separate set of service charge accounts is prepared annually.
